1. Agreement to terms

These Terms of Service ("Terms") govern your access to and use of the GWIXY mobile application, website, and related services (collectively, the "Services") operated by GWIXY Technologies ("GWIXY," "we," "us," or "our").

By accessing or using GWIXY, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use GWIXY. By using the Services, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

If you use GWIXY on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Description of services

GWIXY provides a health intelligence platform that connects signals from your body, including facial scans, logged metrics, and behavioral data, to deliver personalized wellness insights, progress tracking, and community features.

We may modify, suspend, or discontinue any part of the Services at any time. We will make reasonable efforts to notify users of material changes that affect core functionality.

4. Health disclaimer

GWIXY IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. The Services are intended for general wellness and informational purposes only.

Always consult a qualified healthcare professional before making decisions about your health. Never disregard professional medical advice or delay seeking it because of something you read or receive through GWIXY.

In case of a medical emergency, contact your local emergency services immediately.

5. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.

You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

6. Acceptable use

You agree not to misuse the Services. Prohibited conduct includes:

• Violating any applicable law or regulation.
• Attempting to gain unauthorized access to GWIXY systems or other users' accounts.
• Reverse engineering, scraping, or extracting data except as permitted by law.
• Uploading malicious code, spam, or content that infringes third-party rights.
• Using GWIXY to harass, abuse, or harm others.
• Misrepresenting health data or impersonating another person.

7. Intellectual property

GWIXY and its licensors own all rights, title, and interest in the Services, including software, design, trademarks, logos, and content. These Terms do not grant you any ownership rights.

You retain ownership of content you submit to GWIXY. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, process, and display it solely to operate and improve the Services.

8. Subscriptions & payments

Certain features may require a paid subscription. Pricing, billing cycles, and renewal terms will be presented at the point of purchase through Google Play or other authorized payment channels.

Subscriptions are subject to the payment provider's terms. Refund requests are handled in accordance with applicable store policies and local consumer protection laws.

9. Termination

You may stop using GWIXY at any time by deleting your account or uninstalling the app. We may suspend or terminate your access if you violate these Terms or if required for legal or security reasons.

Upon termination, provisions that by their nature should survive, including disclaimers, limitations of liability, and dispute resolution, will remain in effect.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or that insights generated will be accurate or complete.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GWIXY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL.

Our total liability for any claim arising from these Terms or the Services shall not exceed the greater of (a) the amount you paid us in the twelve months before the claim, or (b) one hundred U.S. dollars (USD $100).

12. Indemnification

You agree to indemnify and hold harmless GWIXY from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services, your content, or your violation of these Terms.

13. Governing law & disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any dispute arising from these Terms or the Services shall be resolved through binding arbitration on an individual basis, except where prohibited by law. You waive any right to participate in a class action.
